Charges against Lakeland father accused of killing daughter dropped

Bartow, Florida - Timothy King, 32, of Lakeland has spent 15 months in jail accused of killing his 5-month-old daughter.

His trial was supposed to start next month until a the state made a surprising move on Thursday.

Back in July of 2009, Lakeland Police arrested King at his home after his daughter, Kyra King, died while in his care.

King has always maintained his innocence, saying he thought something was wrong with her when he picked her up from daycare that day.

Police say the baby died from blunt force trauma to her head at the hands of her father.

Then, almost one year to the day of Kyra's death, another 5-month-old child, Zachary Quijano, suffered a "strikingly similar" death at the same exact daycare, Wilson's Child Care in Lakeland.

King's lawyers say that evidence swayed the state to drop the charges.

"It was exhilirating and thrilling yesterday to have this man, who we all here believed was innocent, to have that vindicated in court, and now he can go on with his life.  It is not going to be the same life because nobody could have the same life after going through this," said King's lawyer, public defender Candy Murphy of the 10th Judicial Circuit.

During his time in jail, King wasn't able to grieve with his wife, Christine, over the death of their daughter.

He was also not allowed to see his 6-year-old son, T.J, because the Department of Children and Families opened up their own case.

That investigation is separate from the criminal one and is not yet resolved, with only one week left before Christmas.

While King has been cleared, the question now is, what happens to the daycare?  10 News is going to find that out in the coming days.
